The human right to life and his body’s integrity and safety is legally guaranteed;so as not to take benefits of the advantages of moving organs from the dead to the living on the legitimacy;the importance of addressing the legal control of this process stands out. Therfor the Algerian legislator prearrange the human organ transplantation in the protection and promotion of health act which contained detailed conditions to transfer and transplant organ from the dead to the living. This can be devided into general and special so it is assumed that the aim from it to encourage the transfer and transplant of human organs based on medical determinism but within the frame of legal legitimacy from which avoid process caveats is guaranted and what may have negative consequences that is not accepted religiously nor medically or legally.
