أصول الترجيح عند الإمام مالك بين القواعد الكلية وخبر الواحد

ملخص: تُشكّل مسألة ترجيح القواعد الكلية على خبر الواحد إحدى القضايا الأصولية التي تُبرز عمق الفكر الفقهي عند الأئمة المجتهدين، وفي مقدمتهم الإمام مالك بن أنس. فقد اعتمد الإمام مالك في بناء مذهبه على منظومة ترجيحية دقيقة، تُعلي من شأن الأصول القطعية، والعمل المستقر في مدينة النبي ﷺ، مما يُثير تساؤلات عميقة حول حدود الاحتجاج بخبر الواحد. وتنبع أهمية هذا الموضوع من كونه يكشف عن توازن منهجي بين المحافظة على النص الشرعي من جهة، وبين تحقيق المقاصد واستيعاب السياق من جهة أخرى، مما يجعله محورًا حيويًا في الدراسات الأصولية المعاصرة. فماهي الضوابط المنهجية التي اعتمدها الإمام مالك في هذا الترجيح؟ وهل ما إذا كانت هذه الضوابط تمثل تحولًا في معيار القبول للأحاديث؟ أم أنها اجتهادٌ مؤصّلٌ في إطار الأصول الفقهية؟ هذا ما سنحاول الكشف عنه من خلال هذه الدراسة. Abstract: The issue of preferring general legal maxims over solitary hadiths represents one of the foundational questions in Islamic legal theory, highlighting the depth of juristic reasoning among the leading scholars—foremost among them Imam Malik ibn Anas. Imam Malik constructed his legal school upon a meticulous framework of preference, giving primacy to definitive principles and the established practice of the people of Medina, the city of the Prophet ﷺ. This approach raises profound questions regarding the limits of relying on solitary reports (khabar al-wāḥid). The significance of this topic lies in its revelation of a methodological balance: preserving the integrity of the textual sources on one hand, while fulfilling the higher objectives of the Sharia and engaging with contextual realities on the other. This balance renders the issue a central concern in contemporary studies of legal theory. What are the methodological criteria Imam Malik employed in this form of preference? Do these criteria signal a shift in the standards for accepting hadiths, or are they a well-grounded form of ijtihād within the framework of Islamic legal principles? These are the questions this study seeks to explore.
