The protection of European digital identity is considered one of the top priorities of the European legislator, due to the importance of this right, which enables individuals to carry out various transactions on the one hand, and protects European digital sovereignty on the other—especially in light of the highly advanced technological developments taking place across Europe. In response to the threats that may affect this category of rights, Europe adopted Regulation No. 2014/1183, which establishes the European framework for digital identity. This regulation directly addresses the issue, as the European legislator seeks to strike a balance between technological progress and the protection of the components upon which digital identity is based. However, can European legal texts be considered the primary foundation for protecting digital identity? This is the question we will attempt to address in this article.
