اجراء تعيين حدود الأملاك العمومية الطبيعية والآثار المترتبة عنه

الملخص
لقد اعتمد المُشَرِّع الجزائري اجراء تعيين الحدود كوسيلة لإدماج الاملاك الطبيعية في الاملاك العامة، حيث تتحكم في هذه العملية مجموعة من الضوابط القانونية التي تفرز قرار اداري بتعيين الحدود ذو طبيعة كاشفة للظاهرة الطبيعية، وكذا ضوابط تقنية منصوص عليها في قانون الاملاك الوطنية تقوم بها جهات ادارية محددة وفق برنامج تعده بصفة مسبقة. ينجم عن عملية تعيين الحدود مجموعة من الآثار بالنسبة للملاك المجاورين تتجسد في صورة ضمانات لهؤلاء تبدأ باستشارتهم أثناء عملية التعيين وقد تنتهي في بعض الحالات بحصولهم على تعويض ، واخرى تخص الملك الطبيعي الذي صار ملكا عاما يتمتع بالحماية الاستثنائية بموجب قانون الاملاك الوطنية، بالإضافة الى التزام الادارة بما تفرزه الطبيعة من آثار مقررة لوجود الملك العمومي الطبيعي من عدمه. The Algerian Legislature has adopted the delimitation procedure as a means of integrating natural property into public property, where this process is controlled by a set of legal controls that result in an administrative decision to delimit the boundaries of a revealing nature of the natural phenomenon, as well as technical controls stipulated in the National Property Law carried out by specific administrative bodies according to a program prepared in advance. The delimitation process results in a set of effects for neighboring owners, embodied in the form of guarantees for them, starting with their consultation during the designation process and may end in some cases with compensation, and others related to the natural property, which has become a public property enjoying exceptional protection under the National Property Law, in addition to the commitment of the administration to the effects of nature of the existence of the natural public property or not.
