الملخص
نظام محافظ الدولة جزء لا يتجزأ من النظام القضائي الإداري، يشوبه في الجزائر غموض واضح نابع من تذبذ في نظرة المشرع له، حيث اعتبره لفترة طويلة نظام موازي لنظام النيابة العامة في القضاء العادي ،ثم تراجع عن ذلك من خلال تعديل جذري في نظام محافظ الدولة يحاول المشرع من خلاله تعزيز مكانته من خلال مهام قضائية و مهام استشارية و أخرى إدارية ،و يتمحور هذا البحث حول تقييم نظام محافظ الدولة في الجزائر من خلال مركزه و صلاحياته المختلفة Abstract: The State Commissioner system constitutes an integral part of the administrative judicial framework in Algeria. However, it remains marked by considerable ambiguity, primarily due to its practical implementation and perceived derivation from French legal traditions. Historically viewed as a parallel to the Public Prosecutor within the ordinary judiciary, the system is now undergoing substantial reform. A draft law aims to redefine its role, granting it both judicial and administrative responsibilities to enhance its institutional standing. This study critically evaluates the State Commissioner model in Algeria, focusing on its structure, core functions, and its evolving contribution within the administrative justice system
