القاعدة المقصديّة ومكانتها في الاجتهاد الفقهي المعاصر

الكاتب : عمر بنعربيّة .

الملخص

The science of Maqāṣid (higher objectives of Islamic law) has increasingly attracted scholarly attention in recent times, due to its relative independence from other Islamic sciences, particularly jurisprudence. Nevertheless, a significant portion of its subject matter remains the focus of ongoing debate, reflecting the emergence of new epistemological and methodological challenges that traditional juristic thought had not previously addressed with such analytical depth. Among the central concepts in this contemporary discourse is that of "Maqāṣid-based Ijtihād", which refers to the process of deriving legal rulings based on the consideration of the divine objectives of Sharīʿah. This concept does not represent a break from tradition, but rather a continuation of a methodology already present—albeit implicitly—in the legal practices and fatwas of earlier jurists. The innovation lies in the effort to systematize this approach through precise methodological tools that enable scholars to address new legal cases (nawāzil) in light of the maqāṣid. This has given rise to the idea of Maqāṣid-based legal maxims, which conceptualize maqāṣid as comprehensive meanings from which general rules can be derived and applied to specific legal situations. Such a development lays the foundation for a renewed and principled juristic methodology rooted in a refined understanding of Islamic legal objectives.
