Abstract: Cultural Liberties are considered the cornerstone of the second generation of human rights, which are established through both the human right to participate in cultural life and the right to cultural communication. The latter remains a fundamental pillar in defining the national identity of any person in any country and always constitutes a key dimension of sustainable development. The degree of attention given to the cultural aspect as a factor of development and identity can be assessed through a set of determinants and data, most notably the constitution and the legislation that governs it. The state is the guarantor of the right to culture, which is a two-way right—meaning the right to access cultural content and also the right to produce cultural content. These two dimensions have been manifested in the rest of the Maghreb legislations.
