الملخص
الملخص: لا قيام لدولة القانون إلا بالارتقاء بعملية صناعته فيها ،وهي عملية شاقة تتطلب قدرا كبيرا من الفعالية وتظافر الجهود بين مختلف الهيئات المشاركة في صياغتها، كمجلس الدولة بوظيفته الاستشارية، ومختلف تدخلات القضاء الدستوري، و الذي استطاع أن يرسي العديد من المبادئ والأصول ،والتي أسهمت فعليا في تجويد التشريع، والحد من مظاهر اعتلاله كمعضلة التضخم التشريعي. Abstract: The rule of law cannot be established without improving the process of its creation, which is a difficult process that requires a lot of efficiency and concerted efforts between the different bodies involved in its formulation, such as the Council of State with its consultative function, and the different interventions of the constitutional judiciary, which has been able to establish many principles and foundations, which have effectively contributed to improving legislation and limiting the manifestations of its weaknesses, such as the problem of legislative inflation.
