دور سلطات الضبط الإداري اللامركزية في مجال حماية المستهلك

الملخص
تهدف هذه الدراسة إلى تبيان تحديد سلطات الضبط الإداري اللامركزية في مجال حماية المستهلك، بالإضافة إلى تبيان دورها في هذا المجال من خلال تسليط الضوء على اختصاصاتها من خلال ما تصدره من قرارات ولائية أو بلدية من أجل فرض ضوابط على الراغبين في ممارسة نشاطات معينة. وقد توصلت الدراسة إلى أن سلطات الضبط الإداري اللامركزية تسعى إلى حماية النظام العام بجميع مدلولاته كحماية المستهلك الذي يعد الطرف الضعيف في العلاقة الاستهلاكية، وبالتالي فهي تسعى إلى ضمان التوازن بين مصالح المتعامل الاقتصادي ومصالح المستهلك، بالإضافة إلى توسع نطاق الضبط الإداري وذلك راجع إلى إنطواء عنصر حماية المستهلك تحت مظلة الحفاظ على الصحة العامة. This study aims to clarify the identification of decentralized administrative oversight authorities in the field of consumer protection, in addition to demonstrating their role in this area by highlighting their competencies through the decisions they issue at the state or municipal level in order to impose regulations on those wishing to engage in certain activities. The study concluded that decentralized administrative oversight authorities seek to protect public order in all its meanings, such as protecting the consumer, who is considered the weak party in the consumer relationship. Therefore, they strive to ensure a balance between the interests of the economic operator and the interests of the consumer, in addition to the expansion of the scope of administrative oversight
