The Probative Value Of Scientific Expert Evidence And Its Role In Shaping The Criminal Judge’s Conviction

Authors : Bouzouina Mohamed Yacine .

Abstract

While the judge holds the highest authority and expertise in legal matters, legislation allows him to consult specialists when scientific or technical issues arise within his jurisdiction. Scientific expertise plays a crucial role in criminal evidence by aiding the uncovering of truth, supporting the judicial police, and assisting in establishing the material or moral responsibility of the accused. Despite its evidential weight, the Algerian legislator maintains that such expertise remains subject to the judge’s discretionary authority, although in practice it is often guided by expert reports
