الملخص
يثير الطلاق بالتراضي غير القضائي المبرم في فرنسا العديد من الإشكالات، خاصة عندما يكون أحد طرفي الاتفاق أو كلاهما جزائريًا ويرغبان في تنفيذه في الجزائر. فالقانون الجزائري، لا يعترف بهذا النوع من إنهاء الرابطة الزوجية إلا بحكم قضائي، مما يُولد تحديات قانونية وعملية كبيرة لتطبيق اتفاق الطلاق الأجنبي غير القضائي في الجزائر. تهدف هذه الورقة البحثية إلى مناقشة هذه الإشكالية وتقديم حلول قانونية ممكنة لمعالجتها. Divorce by mutual consent without going through the courts and concluded in France raises several problems, especially when one or both parties to the agreement are Algerian, and those who want to implement it in Algeria, where Algerian Law does not recognize this type of dissolution of the marital bond. divorce can only be proven by a judgment. This poses a major problem in practical terms for implementing a foreign judgment of divorce by mutual consent that takes place outside the judiciary in Algeria. Through this research paper, we try to raise this problem and try to suggest possible solutions for it.
