الباعث على الجريمة وأثره على تخفيف العقاب في التشريع العماني

الملخص
يندفع الفرد وراء ارتكاب الجريمة بدوافع مختلفة قد يكون منها الشريف كالإقدام على الجريمة بدافع الرحمة، وقد يكون منها الدنيء كالانتقام أو الطمع وغيرها؛ ولكنه في نهاية الأمر يكون بالفعل قد ارتكب فعلاَ يجرمه القانون؛ لذلك يدور البحث حول مدى تأثير الباعث على عقاب الجاني؛ إلا إنه يقتصر في بيان أثره على تخفيف العقاب. وبذلك يهدف البحث إلى بيان موقف المشرع العماني في مدى الاعتداد بالباعث على الجريمة في تخفيف العقاب، وقد اتبع الباحث المنهج الوصفي، والمنهج التحليلي في البحث والاستقصاء، كما اقتصرت حدود الدراسة من الناحية التشريعية على التشريع العماني بينما حدوده الموضوعية فقد اقتصرت على بيان أثر الباعث في تخفيف العقاب. وعن خطة البحث في التقسيم فهو يحتوي على مبحثين: الأول يدور حول ماهية الباعث على الجريمة، والثاني يدور حول موقف المشرع العماني من الباعث كسبب لتخفيف العقاب Abstract An individual may be driven to commit a crime by various motives, some of which may be noble—such as committing the act out of compassion—while others may be base, such as revenge, greed, and the like. However, in the end, the individual has indeed committed an act criminalized by law. Therefore, this research revolves around the extent to which the motive affects the punishment of the offender, with the focus limited to its role in mitigating the penalty. The aim of this study is to clarify the stance of the Omani legislator on the consideration of motive in reducing punishment. The researcher has adopted both the descriptive and analytical methods for research and investigation. The legislative scope of the study is limited to Omani legislation, while its substantive scope is confined to examining the effect of motive on penalty mitigation. As for the research structure, it is divided into two sections: The first discusses the nature of motive in crime. The second addresses the stance of the Omani legislator on motive as a cause for mitigating punishment.
