Abstract The doctor's work is very important in human life although it is not without prejudice to the human body, which requires the doctor to be more careful not to make medical errors that sometimes lead to the death of the patient. So there had to be legislative regulation to deal with these mistakes, and what is really problematic is how the doctor can do his work by doing the care necessary to heal a human being and how the doctor's mistake is being met in a criminal manner. The research was limited to the scope of the medical error, the aim of which was to identify the images of the medical error that entailed the penal liability of the doctor, the legal rules governing it, and the researcher followed the descriptive and analytical curriculum in his study. Research has been confined to Omani legislation, and one of the most important consequences is that some sanctions are disproportionate to the scale of the offence committed. The research has been divided into first investigators dealing with what is a medical error, while the second examines: the status of a medical error from criminal responsibility and the burden of proving it
