The Regulation Of Non-muslim Religious Practices In Algerian Legislation

Authors : Bentayeb Djillali . Ben Aïchouche Omar .

Abstract

This study examines the regulation of non-Muslim religious practices within Algerian legislation—an issue intrinsically linked to freedom of belief, a fundamental human right enshrined in international instruments, regional conventions, and domestic laws. Given growing global attention to religious rights, particularly as minorities face persecution and discrimination on religious grounds, this topic holds significant relevance for human rights scholars and practitioners at national, regional, and international levels. The sensitivity of this matter necessitates legislative intervention to govern non-Muslim religious practices, especially in light of Algeria’s Christian and Jewish communities, as Algerian lawmakers had not addressed this issue through dedicated legislation before 2006, where this gap was rectified with the introduction of Ordinance 06-03, which established the legal framework governing the conditions and regulations for non-Muslim religious observance.
