آثار حق العدول عن العقد الإلكتروني

الملخص
يهدف هذا البحث إلى تحديد آثار العدول عن العقد الإلكتروني، أحد الوسائل القانونية الحديثة التي تهدف إلى حماية المستهلك، حيث يمنح هذا الحق للمستهلك إمكانية الرجوع عن العقد خلال فترة زمنية محددة دون تحمل تبعات قانونية إلا ما هو منصوص عليه قانونًا، يُنتج هذا الحق آثارًا على طرفي العقد: المستهلك والمزود، والمنهج المتبع في هذا البحث المنهج الوصفي التحليلي. وقد توصل البحث إلى نتائج منها، أن التشريع الأردني، رغم أنه قد خطى خطوات إيجابية في تنظيم التجارة الإلكترونية عبر قانون المعاملات الإلكترونية، إلا أنه لا يزال بحاجة إلى مزيد من التفصيل بشأن حماية المستهلك، وخاصة في ما يتعلق بحق العدول، ومن التوصيات، إدراج نصوص صريحة ضمن قانون حماية المستهلك الأردني أو قانون المعاملات الإلكترونية تنظم حق العدول بشكل مفصل، بما في ذلك تحديد المدة الزمنية للعدول، والإجراءات المطلوبة، وضمان خلو العدول من أي مصاريف مالية إضافية. This research aims to identify the electronic contract's right to recourse, one of the legal texts that comprise the agreement. This modern right allows the consumer to revert to the contract within a specified period of time without incurring secondary consequences other than those stipulated by law. This law creates the right to eliminate both parties to the contract: the obligor and the provider. The methodology used in this descriptive, deconstructive, experimental research. The research reached results, including that although the Jordanian system has improved e-commerce, it is still necessary to carefully examine everything related to protection, especially with regard to the field. By virtue of including clear provisions within the Jordanian Protection Law or the Electronic Transactions Law to regulate a unified right in detail, including specifying the time period for the required work, with the exception of the absence of any additional electronic expenses.
