الملخص

تناقش هذه الدِّراسة -التعليق على الحكم القضائيِّ رقم 8393 لسنة 2021 الصَّادر عن محكمة صلح جزاء غرب عمَّان: الدلالات القانونيَّة بين الوضوح والغموض والإجراء-، وقُسِّمت الدِّراسة على مبحثين هما: الإطار الموضوعيِّ في المبحث الأول، والإطار الذاتيِّ في المبحث الثاني، استعملت الدِّراسة منهج التَّحليل اللُّغوي البنيويِّ الوظيفيِّ لنصوص القانون محل النقاش، وتوصلت الدِّراسة إلى وجوب إجراء البينة الفنيَّة في دور التَّحقيقِّ، وعليه أوصت الدِّراسة بالتنصيص على إجراء الخبرة الفنيِّة في الجرائم الإلكترونيَّة منذ أعمال الاستدلال، وتمكين قاضي التَّحقيق والحكم من الولوج إلى حسابات التَّواصل الاجتماعيِّ، والسَّماح بإثبات الوقائع الإلكترونيَّة غير المُفبركة بالبينة الشخصيَّة. This study discusses- the commentary on Ruling No. 8393 of 2021 of the Magistrates' Court of Western Amman: The legal connotations between clarity, ambiguity and procedure- The study has been divided for two parts: Substantive framework in the first part and subjective framework in the second part and the study used the methodology of structural linguistic Functional analysis of the texts of the law under discussion, The study found that the technical evidence should be conducted in the investigation stage. and the study therefore recommended that expertise in cybercrime be provided At the preliminary investigation stage, Enabling the investigating and sentencing judge to access social media accounts and allow for the establishment of Non-fabricated electronic facts.
