قراءة قانونية تحليلة لقوانين الاعلام الجزائرية 2023 المكاسب والتحديات للمشهد الاعلامي الجزائري

الملخص
من خلال هذه الدراسة القانونية طمحنا الى بناء مقال شامل يعرض الجوانب المختلفة لقوانين الإعلام الجزائرية 2023، وتحليلها والتطرق الى اهم النقاط التي تميز بها كل من قوانين الاعلام الجزائرية الحديثة والمشهد الاعلامي الجزائري ، و قمنا بتقديم تحليل متوازن حول المكاسب والتحديات التي يواجهها المشهد الإعلامي الجزائري التشريعي والقانوني .وبالاعتماد على المنهج التحليلي الوصفي وتحليل المواد القانونية قمنا بذكر الجديد التي جاءت به هذه القوانين فيما يخص تكريس مبادئ حرية التعبير ، والغموض الذي يصف بعض مصطلحات مواده والموجودة في القوانين الصادرة في سنة 2023. فمن المكاسب التي جاءت بها هذه القوانين على سبيل الذكر تنظيم الصحافة الرقمية والالكترونية وتكريس الحق في الاعلام وحرية التعبير، لكن هذه القوانين لا تزال تواجه تحديات من بينها توضيح موادها وان تفعل المؤسسات التي جاءت بها ،لضمان تضمن الممارسة الكاملة للحقوق والحريات وتعزز المهنية في مجال الإعلام وتكرس آلياتِ الضبط Through this legal study, we aimed to construct a comprehensive article that presents the various aspects of Algeria’s 2023 media laws, analyzes them, and highlights the key features of both the modern Algerian media laws and the Algerian media landscape. We offered a balanced analysis of the gains and challenges facing the Algerian legislative and legal media scene. Relying on the descriptive analytical method and legal text analysis, we identified the novelties introduced by these laws, particularly in terms of enshrining the principles of freedom of expression, as well as the ambiguity characterizing certain terms and provisions included in the 2023 legislation. Among the notable gains of these laws are the regulation of digital and electronic journalism, the consolidation of the right to information, and the promotion of freedom of expression. However, these laws still face challenges, including the need to clarify their provisions and activate the institutions they introduced, in order to ensure the full exercise of rights and freedoms, enhance professionalism in the media field, and establish effective regulatory mechanisms.
