الملخص
الملخص: خصص المشرع في مجال الطلبات العمومية عدة هيئات رقابية تمارس، إما رقابة قبلية وأخرى بعدية وذلك حفاظا على أخلقة وعقلنة تسيير المال العام، حيث إستحدث لجنة فتح الأظرفة والتقييم التقني للعروض التي تمارس رقابة قبلية داخلية مياشرة على المصلحة المتعاقدة، والتي إعتبرها كسلطة إقتراح نظرا لما تكتسيه من صلاحيات تجعلها في هذا المركز القانوني. وبالرغم من أن هذه اللجنة يعينها الأمر بالصرف الذي يمثل المؤسسة أو الهيئة الإدارية بموجب قرار أو مقرر، حيث يختار من الموظفين التابعين له ذوو الكفاءات والقدرات للقيام بذات المهام الإدارية والتقنية في نفس الوقت، وتعتبر كألية رقابية فعالة ساهمت بشكل كبير في التسيير العقلاني للمال العام. إلا أنها في إنشاءها؛ تشكيلها؛ صلاحياتها؛ تنظيمها عرفت بعض الإختلالات الواجب تداركها حتى تكون منسجمة ومتجانسة على مستوى كل الإدارات العمومية بشتى أنواعها، ولا تدع مجالا للشك في عملية إختيار المتعامل المتعاقد. لذلك إرتئينا من خلال هذا العمل الأكاديمي دراسة هذه اللجنة، دراسة أكاديمية معمقة نسعى من خلالها إلى سد كل الإختلالات والثغرات، والمساهمة بالقدر المستطاع بإقتراحات وتوصيات نابعة من دراسة شاملة لواقعين عملي ونظري، وما تعانيه هذه اللجنة من صعوبات في مسألة إختيار المتعامل المتعاقد وذلك لا يتأتى إلا بناءا على دفتر شروط محكم وإستنادا إلى المبادئ العامة للصفقات العمومية. Abstract: In the field of public procurement, the legislator has allocated several oversight bodies that exercise either prior or subsequent oversight, in order to preserve the ethics and rationality of public money management. He created the Bid Opening and Technical Evaluation Committee, which exercises direct internal prior oversight of the contracting authority, and which he considered a proposing authority, given the powers it possesses that give it this legal status. Despite the fact that this committee is appointed by the disbursement order representing the institution or administrative body by a resolution or decision, where he chooses from his subordinate employees with competencies and abilities to perform the same administrative and technical tasks at the same time, it is considered as an effective oversight mechanism that has contributed significantly to the rational management of public funds. However, in its establishment, composition, powers, and organization, it knew some imbalances that must be corrected so that it is harmonized and homogeneous at the level of all public administrations of all kinds, and leaves no room for doubt in the process of selecting the contracting agent. Therefore, through this academic work, we decided to study this committee, an in-depth academic study through which we seek to fill all imbalances and gaps, and contribute as much as possible with suggestions and recommendations stemming from a comprehensive study of two practical and theoretical realities, and the difficulties this committee suffers from in the matter of selecting a contracting agent based on a tight code of conditions and based on the general principles of public procurement.
