حماية مقر البعثات الدبلوماسية في ظل القانون الدولي العام Protecting The Headquarters Of Diplomatic Missions Under Public International Law

الملخص
الملخص: يعتبر التمثيل الدبلوماسي بكل أنماطه وسيلة للتواصل وحماية المصالح الدول المتبادلة، وذلك بنقل آراء وموقف الدول عن طريق مختلف بعثاتها الدبلوماسية، بتالي لقيام هذه الأخيرة بمهامها على أكمل وجه يجب على الدول الموفد لديها توفير امتيازات وحصانات سواء بشقها البشري بحماية أعضائها من كل اعتداء، وشقها المادي بحماية مقراتها، وفق نصوص اتفاقية فينا للعلاقات الدبلوماسية لعام 1961، الا أن هذه الامتيازات والحصانات الممنوحة لهذه البعثات الدبلوماسية، يمكن أن تكون عائق على سيادة والأمن الوطني لتلك الدول أي الموفد لديها. تهدف هذه الدراسة لتسليط الضوء على أهم الحصانات التي تتمتع بها مقرات البعثات الدبلوماسية، والقيود التي ترد عليها، وسنتعمد في هذه الدراسة على منهج تحليلي بتحليل مختلف النصوص الدولية، وتطبيقي بالتطرق الى مختلف القضايا التي مست بحرمة مقرات البعثات الدبلوماسية، وصولا الى أهم النتائج من التطبيق الفعلي لجميع النصوص القانونية الدولية فيما يخص حصانات مقرات البعثات الدبلوماسية، ومن بين التوصيات التي يمكن الوصول اليها ضرورة عدم تعسف البعثات الدبلوماسية في تحجج بالاعتبارات الإنسانية وحالة الضرورة كحجج لعدم تسليم الفارين من العدالة الذين يلجؤون الى مقرات البعثات الدبلوماسية. الكلمات المفتاحية: الحصانات والامتيازات؛ البعثات الدبلوماسية؛ الاتفاقيات الدولية؛ مقر البعثات الدبلوماسية. Abstract: Diplomatic representation, in all its forms, is a means of communication and protection of mutual interests between countries, by conveying the views and positions of countries through their various diplomatic missions. Therefore, in order for these missions to carry out their duties to the fullest extent, the countries receiving them must provide privileges and immunities, both humanly, by protecting their members from any aggression, and materially, by protecting their headquarters, in accordance with the provisions of the Vienna Convention on Diplomatic Relations of 1961. However, these privileges and immunities granted to these diplomatic missions can be an obstacle to the sovereignty and national security of those countries, i.e., the countries receiving them. This study aims to shed light on the most important immunities enjoyed by diplomatic missions and the restrictions imposed on them. This study will adopt an analytical approach, examining various international texts, and a practical approach, addressing various issues affecting the sanctity of diplomatic missions. The aim is to arrive at the most important conclusions from the actual application of all international legal texts regarding the immunities of diplomatic missions. Among the recommendations that can be reached is the need for diplomatic missions to refrain from arbitrarily invoking humanitarian considerations and the state of necessity as justifications for not extraditing fugitives who seek refuge at diplomatic missions.
