An exception to the principle of the inviolability of the human body is recognized in the legitimacy of medical practice. A physician is permitted to intervene and affect the human body, whether through therapeutic or surgical procedures, as necessitated by medical treatment. Given the seriousness of such interventions on the one hand, and the negligence or failure of doctors to fulfill their obligations on the other, it has become essential to protect patients from medical errors that may compromise their safety during medical procedures. This necessitates the imposition of medical liability, which is generally contractual in nature but may be tortious in exceptional cases. Medical errors committed during medical interventions may relate to medical ethics—such as the physician’s failure to inform the patient and obtain their consent—or to the technical aspects of medical practice, including errors in treatment or surgery, or even the loss of a chance for recovery or survival. Despite the fact that medical error is a fundamental element in establishing medical liability, the legal provisions governing the practice of medicine have neglected to regulate it, leaving the matter to general medical principles, which are insufficient in this regard.
