من آثار القاعدة اللغوية ودورها في استنباط وتـرجيح الحكم الفقهي

الملخص

ملخص: يتناول بحثنا العلاقة القائمة بين القاعدة اللغوية والآراء الفقهية وتأكيد الصلة الوثيقة بين علم النحو وبين العلوم الشرعية ، وهو ضمن ما يعرف بفن التخريج الفقهي على الأصول النحوية الذي يعالج رد الأحكام الفقهية التفصيلية إلى القواعد النحوية التي اعتمدها العلماء لاستنباط تلك الأحكام من النصوص الشرعية مع بيان أوجه اختلافهم في ذلك . وخصصنا موضــوع بحثنا فـي " آثار القاعدة اللغوية ودورها في استنباط وتـرجيح الحكم الفقهي " فـذكـرنا بـوادر الاِحتـجاج بالقاعدة اللغوية لدى الرعيل الأول من السابقين صحابة رسول الله صلى الله عليه وسلم ، وعرجنا على آثار الاِنتماء المذهبي على تلك العلاقة القائمة بين الآراء الفقهية والمفاهيم اللغوية ، ثم انتقلنا إلى ذكر مظاهر الاِحتجاج بالقاعدة اللغوية ودورها في ترجيح الحكم الفقهي فعالجنا مسألتين : أولاهما تفرض اللغة فيها على المجتهد الترجيح بين الآراء الفقهية وثانيهما يمكن الجمع بين الآراء المختلف فيها وإن دلَّ ظاهرها على خلاف ذلك ، وقد توصل هذا البحث إلى عدد من النتائج منها : أن القواعد اللغوية تـُعْـتَـمَـدُ حين تتعدد الآراء الفقهية في ترجيح واستنباط الأحكام ما لم تُعارِض تلك القواعد نصًا شرعيًا أو تخالف إجماعا . Abstract: Our research deals with the relationship between the linguistic base and jurisprudential opinions and the confirmation of the close relationship between grammar and the forensic sciences. They differ in that. I have summarized my research topic in (the effects of the linguistic rule and its role in deducing and recommending jurisprudence We have already talked about the signs of protesting the linguistic rule of the previous companions of the messenger of God .(may God bless him grant him peace) Also we have referred to the effects of sectarian affiliation on the relationship between jurispudential opinions and linguistic concepts Then we moved on to mentioning the manifestaions of invoking the linguistic rule and its role in giving preference to the jurisprudential ruling We dealt with two issues ,the first of which is that the language imposes on the hardworking the weighting between jurisprudential opinions ,and the second is that the differing opinions can be combined,even if their aparent evidence indicates otherwise,This research reached a number of results, including :Linguistic rules are adopted when there are multiple jurisprudential opinions in weighing and deducing rulings, unless those rules contradict a legal text or contradict a consensus.
