الملخص
ملخص: إن الإنسان كائن اجتماعي بطبعه، وهذا ما يبرر احتياجه لغيره، إذ أنه لا يستطيع أن يُحصِّل حاجاته بنفسه، فلابد له من مساعدة بقية أفراد المجتمع، ما يفرض على كل واحد رعاية جهة التعاون، وفق مراتب مختلفة، بعضها يندرج ضمن الأعمال الواجبة التي يُفرض على الإنسان القيام بها، كتأدية الزكاة، وتحصيل الضرائب وغيرها، وبعضها الآخر متروك لإرادة الشخص، وقدرته مما يعرف بالعمل التطوعي. العمل التطوعي أصل من أصول التعاملات الاجتماعية، وضرورة من ضرورات استقرار المجتمع واستمراره، وهذا الأصل يقف على جملة من الأصول الحقوقية، باعتماد منهج مقارن بين الفقه الإسلامي والقانون الوضعي، وأيضا ببيان مفهوم العمل التطوعي في كل من النظامين، ضمن المطلب الأول، والحقوق المتفرعة عنه والتي تشكل مقتضيات تستدعيها ضرورة العمل التطوعي وذلك من خلال المطلب الثاني. هذا وقد خرج المقال بجملة من الفوائد والنتائج مثبتة ضمن خاتمة البحث. Abstract Humans are inherently social beings, which explains their need for one another. An individual cannot fulfill all their needs alone and thus requires the support of other community members. This creates an obligation for each person to engage in cooperative practices to various extents. Some of these responsibilities fall under mandatory actions, which one is required to perform, such as paying zakat (charity) and taxes. Other actions are voluntary, based on a person’s will and capacity, known as Volunteerism. The latter is a foundational element of social interactions and is essential for the stability and continuity of society. Built upon a set of rights-based principles, volunteerism is examined through a comparative methodology between Islamic jurisprudence and secular law. Also, this article attempts to clarify the concept of volunteer work in each system within the first section, and the rights associated with it, which emerge as necessary conditions for volunteerism, in the second section. The article concludes with a summary of the benefits and results presented in the conclusion of the research.
