Abstract
يعُبر مصطلح "الدستور الاقتصادي" عن المبادئ المنصوص عليها في الدستور فيما يخص الجوانب الاقتصادية المختلفة. يهدف الدستور من نصه على هذه المبادئ إلى إعطائها قدسية تشريعية بحيث تلتزم القوانين والقرارات في البلاد بعدم مخالفتها. تفاوت تنظيم الاقتصاد في الدستور السوري بين دستور وآخر. بعض الدساتير اقتصرت على بعض المبادئ الأساسية ذات الطبيعة الاقتصادية، بينما توسعت دساتير أخرى في المواد ذات الطبيعة الاقتصادية، التي توزعت بين مبادئ أساسية، وحقوق وحريات، بالإضافة إلى الإشارة إلى بعض القوانين ذات الطبيعة الاقتصادية. تهدف دراستنا إلى بحث الكيفية التي تناولت بها الدساتير السورية الجانب الاقتصادي، مع المقارنة فيما بينها، وبيان إيجابياتها وسلبياتها، وصولاً إلى تقديم مقترحات لتنظيم الموضوع الاقتصادي بالشكل الأمثل في دستور سوريا القادم. خاصة في ظل التغييرات السياسية التي شهدتها سوريا، والتي ستنعكس بالتأكيد على الجانب الاقتصادي وتنظيمه في الدستور. مع صعوبة دراسة الجانب الاقتصادي في كل الدساتير السورية، سيعتمد بحثنا على الدراسة والمقارنة بين 4 دساتير، وهي أهم الدساتير التي مرت على سوريا، وهي دستور 1950، دستور 1973، دستور 2012، الإعلان الدستوري الجديد 2025، موضحين كيفية معالجتها للمبادئ الاقتصادية، ونقاط الاتفاق والاختلاف فيما بينها. The term "economic constitution" refers to the principles enshrined in the constitution regarding various economic aspects. By enshrining these principles, the constitution aims to give them legislative sanctity, ensuring that the country's laws and decisions do not violate them. The regulation of the economy in the Syrian constitution varies from one constitution to another. Some constitutions are limited to a few basic principles of an economic nature, while others expand on economic provisions, which are divided between basic principles, rights, and freedoms, in addition to references to some laws of an economic nature. Our study aims to examine how Syrian constitutions have addressed the economic aspect, comparing them, highlighting their pros and cons, and ultimately offering proposals for optimally regulating the economic issue in the upcoming Syrian constitution. This is particularly in light of the recent political changes Syria has lived, which will certainly be reflected in the economic aspect and its regulation in the constitution. Considering the difficulty of studying the economic aspect of all Syrian constitutions, our research will focus on studying and comparing four of the most important constitutions Syria has ever known: the 1950 Constitution, the 1973 Constitution, the 2012 Constitution, and the new 2025 Constitutional Declaration. We will also highlight how they address economic principles and the points of agreement and disagreement among them.
