الحق النقابي في الجزائر بين مقتضيات التنظيم ومبادئ الحرية النقابية

الملخص
الملخص: يعد الحق النقابي في الجزائر من الحقوق الأساسية المضمونة دستوريًا، حيث عملت الدولة على مواءمة تشريعاتها مع المعايير الدولية المتعلقة بالحرية النقابية، مثل الاتفاقيتين رقم 87 و98 لمنظمة العمل الدولية، وصكوك حقوق الإنسان العالمية. تم تنظيم هذا الحق عبر القانون رقم 90-14، غير أن التطبيق العملي أظهر بعض القيود مثل التضييق الإداري وظهور منظمات نقابية غير تمثيلية. وبناءً على ذلك، قام المشرع بتعديل هذا القانون عبر إصدار القانون رقم 23-02 الذي عزز الاستقلالية النقابية وقلل من تدخلات الإدارة، بالإضافة إلى ضمان حرية التنظيم النقابي والفصل بينه وبين الأنشطة السياسية. ورغم أهدافه في ضمان ممارسة حرة للنقابات تتماشى والمعايير الدولية، ما زالت بعض التحديات قائمة كالتضييق الإداري على تسجيل النقابات، مما يتطلب مزيدًا من الفعالية في تنفيذ القانون لضمان الاستقلالية والممارسة الحرة للحق النقابي. Abstract: The right to trade unionism in Algeria is a constitutionally guaranteed fundamental right. The state has aligned its legislation with international standards related to trade union freedom, such as International Labour Organization (ILO) Conventions 87 and 98, and international human rights instruments. This right was regulated by Law No. 90-14, but the practical application showed some limitations such as administrative restrictions and the emergence of unrepresentative trade union organisations. Consequently, the legislator amended this law by issuing Law No. 23-02, which strengthened trade union autonomy and minimised administrative interference, in addition to guaranteeing freedom of trade union organisation and separating it from political activities. Despite its goals of ensuring the free exercise of trade unions in line with international standards, some challenges remain, such as administrative restrictions on the registration of trade unions, which requires more effective implementation of the law to ensure independence and the free exercise of the right to trade unionism.
