المستجد في الرقابة على نشاط الإعلام عبر الأنترنيت: دراسة على ضوء القانون العضوي 23_14 المتعلق بالإعلام ونصوصه التطبيقية

الملخص
الملخص: يهدف المقال إلى دراسة أهم مستجدات الممارسة الإعلامية عبر الأنترنيت على ضوء الإصلاحات التي تبناها المشرع الجزائري سنة 2023 من خلال القانون العضوي 23_14 المتعلق بالإعلام وكذلك قانوني الصحافة المكتوبة والإلكترونية والنشاط السمعي البصري والتي كرست جميعها حرية الإعلام الإلكتروني والذي يبقى نشاطا مقننا يخضع في ممارسته لعدة أطر رقابية قبلية وبعدية، فقد حاولنا إبراز شروط ممارسة نشاط الإعلام عبر الأنترنيت وتبيان مجموعة الضوابط والأطر الإجرائية المستحدثة التي يمارس في ظلها بالمقارنة مع النصوص السابقة وكذلك تسليط الضوء على مظاهر القصور التشريعي التي تعتريها، وقد توصلنا إلى نتيجة مفادها تشديد المشرع لشروط ممارسة النشاط وتشديد العقوبات الجزائية على المخالفين، بالإضافة إلى تغيير جهة الموافقة على إنشاء الخدمة من هيئة التنظيم القطاعية إلى وزير الاتصال من خلال إيداع التصريح أو الترخيص وكذلك اختلاف إجراءات ممارسته بين الصحافة الإلكترونية والنشاط السمعي البصري، وقد سجلنا تناقض وتعارض بين النصوص المستحدثة وسابقتها خاصة المرسوم التنفيذي 20_332 الساري المفعول والمتعلق بممارسة الإعلام عبر الأنترنت. Abstract: The article aims to study the most important developments in online media practice in light of the reforms adopted by the Algerian legislator in 2023 through Organic Law 23_14 related to the media, as well as the laws of the written and electronic press and audiovisual activity, all of which enshrined freedom of electronic media, which remains a codified activity subject to several prior and subsequent control frameworks,We have tried to highlight the conditions for practicing online media and to clarify the set of new controls and procedural frameworks under which it is practiced in comparison with previous texts, as well as to shed light on the deficiencies manifestations legislative they contain, We have reached the conclusion that the legislator has tightened the conditions for practicing the activity and tightened the criminal penalties for violators, In addition to changing the authority approving the establishment of the service from the Sectoral Regulatory Authority to the Minister of Communications by Deposit of declaration or license, As well as the difference in procedures for practicing it between electronic press and audio-visual activity, We have recorded a contradiction between the new texts and their predecessors, especially Executive Decree 20_332 in effect, which related to the practicing of online media.
