الجزاء الجنائي الدولي بين حتمية احترام مبدأ الشرعية و تحقيق مقومات العدالة الجنائية الدولية

الملخص
ملخص: مر الجزاء الجنائي الدولي بمراحل عديدة عبر أزمنة مختلفة، تميزت كل منها بظروف جعلت القضاء الدولي الجنائي يتفاعل معها ومع الطابع السياسي الذي عاصر قيام المحاكم الجنائية الدولية المؤقتة، التي قيل فيها الكثير عن شرعية الجزاءات التي نطقت بها، إلى أن تمكن المجتمع الدولي من وضع جهاز قضائي دولي دائم، حمل على عاتقه مهمة مكافحة أخطر الجرائم الدولية، ومتابعة المتهمين بارتكابها أيا كانت صفاتهم، ومنعهم من الإفلات من العقاب، عن طريق وضع منظومة للجزاء الجنائي الدولي، تحترم مبدأ الشرعية العقابية، وتحقق مقومات العدالة الجنائية الدولية القائمة على المساواة والإنصاف. : Abstract International criminal punishment has evolved through distinct stages, each shaped by specific circumstances that influenced the progression of international criminal jurisprudence. Initially, this jurisprudence was shaped by the political context accompanying the creation of temporary international criminal tribunals, which generated extensive debates over the legitimacy of the punishments they imposed. Eventually, the international community established a permanent judicial mechanism entrusted with addressing the gravest international crimes, holding perpetrators accountable irrespective of their status, and preventing impunity. This development resulted in a framework for international criminal punishment founded on adherence to the principle of penal legitimacy and the promotion of international criminal justice based on equality and fairness.
