الملخص
يهدف البحث إلى استجلاء معالم التجديد الأصولي في فكر ضياء غوك ألب(Ziya Gökalp) من خلال نظريته الموسومة بـ"أصول الفقه الاجتماعي"، وذلك بتمحيص مدى اتساق هذه النظرية مع معايير التراث الأصولي ومقاصده المنهجية. وقد اعتمد البحث على منهجٍ ثلاثيّ الأبعاد: وصفًا لمفاصل النظرية، وتحليلًا لمضامينها، واستقراءً لما تفرّق من معالمها في مدوّنة غوك ألب، عبر تتبّع عباراته ومقالاته التي بسط فيها رأيه في الفقه وأصوله. ومن أبرز النتائج المتحصّلة أنّ تلك النظرية لم تُبنَ على أساسٍ محرّر من القواعد الأصولية، إذ قُدّم فيها العرف على النص، والذوق المجتمعي على مقتضى الاستدلال، فاختلّ بها ميزان النظر واضطرب منهاج الاجتهاد. وتَتَميَّز هذه الدراسةُ بما انْفردت به من استقراءٍ دقيقٍ لمعالم التجديد في مشروع "أصول الفقه الاجتماعي"، مُستنِدَةً إلى تحليلٍ نصّيٍّ متأنٍ، وموازنةٍ أصوليةٍ منهجيةٍ لم تحظَ بها الدراسات السابقة، ولا سيما في السياق العربي الذي غالبًا ما أغفل هذا الطرح أو تناوله من منظور سوسيولوجيّ محض.This study aims to investigate the features of renewal in the thought of Ziya Gökalp, focusing on his theory known as “Social Usul al-Fiqh”, by critically examining its coherence with the methodological standards and objectives of the classical Usul tradition. The research adopts a tripartite methodology: a descriptive outline of the theory’s structure, an analytical reading of its content, and an inductive extraction of its reformist features from Gökalp’s writings through a close textual analysis. One of the major findings is that the theory lacks a sound foundation in established juristic principles, as it prioritizes custom and collective sentiment over textual authority, thus undermining the balance of reasoning and the rigor of ijtihad. This study is distinguished by its meticulous inductive analysis and systematic comparison, offering insights largely absent in prior research particularly in Arabic academic literature, which has often overlooked or treated this theory from a purely sociological perspective.
