: مُصْطَلَحَاتُ القِيَاسِ الأُصُوليّ بَيْنَ الأَصَالَة والتَّجْدِيد -دراسة تَحْلِيلِيّة -fundamental Measurement Terms Between Originality And Innovation - An Analytical Study

الملخص
ملخص: إن القياس أهم وسائل الاجتهاد، وقد اعتنى الأصوليون بتحقيق مسائلِه واصطلاحاتِه منذ عصر الإمام الشافعي، ولكن الملاحَظ عند المتأخرين كثرة مصطلحاتِه وصعوبةُ استثمارها، وهاهنا يلوحٌ إشكالٌ مفادُه: كيف تطوّرت مصطلحات القياس؟ وما مظاهر الإشكال فيها؟ وفيم تتمثل أهميّة تجديدها؟ وما أهمُّ دعائم هذا التجديد؟ ومِن أجل ذلك جاء هذا البحث ليَكشِف التطور العلمي لمصطلحات القياس منذ أول التدوين فيه، حتى يَصل بعد ذلك إلى أهم إشكالاتها، ويُفصِح عن ضرورة معالجتها بتجديد مصطلحات القياس، ثم يُقَدّم مُقترحًا عَمَليا جادًّا حول دعائم هذا التجديد، وقد جَعَلناه في خمسة مطالب: الأول في أهمية القياس، والثاني في بيان تطور مصطلحات القياس، والثالث أهمّ الإشكالات الاصطلاحية، والرابع في أهمية التجديد المصطلحي، والخامس في دعائمه المقترحة، وقد وصلنا إلى ضرورة التجديد الاصطلاحي لهذا الباب، وقدّمنا دعائمَه. Abstract: Qiyas is the most important means of ijtihad, and fundamentalists have taken care to investigate its issues and terminology since the era of Imam al-Shafi’i, but what has been noted among the latecomers is the abundance of its terminology and the difficulty of exploiting it, and here a problem arises that says: How did the terminology of analogy develop? What are the aspects of the problem? What is the importance of renewing it? What are the most important pillars of this renewal? For this reason, this research came to reveal the scientific development of measurement terminology since its first codification, until it then reaches its most important problems, and reveals the necessity of addressing them by renewing measurement terminology, and then presents a serious practical proposal about the foundations of this renewal, and we have made it into five demands: the first in The importance of analogy, the second in explaining the development of measurement terminology, the third the most important terminological problems, the fourth in the importance of terminological renewal, and the fifth in its proposed pillars. We have arrived at the necessity of terminological renewal for this section, and presented its pillars.
