توثيق عقود الزواج باستخدام الذكاء الاصطناعي

الملخص
تهدف هذه الدراسة إلى بيان أهمية توثيق عقود الزواج، وأثر الذكاء الاصطناعي في إبرام عقود الزواج، وبيان حكم استخدام الروبوت في توثيق عقود الزواج ومسايرة التطور العلمي ومواكبة ما يستجد من اكتشافات واختراعات. ومن خلال البحث توصلت إلى عدة نتائج من أهمها: أن التوثيق شرع من باب المصالح المرسلة حفاظًا على الحقوق وصيانة للأعراض، وأن الأصل في الأشياء الإباحة وعليه فإنه يجوز استخدام الروبوت لإبرام عقد النكاح وهو ما يطلق عليه بالمأذون الذكي. -إباحة توثيق عقد الزواج عن طريق استخدام الروبوت فيكون وسيط بين أركان عقد الزواج وبين القاضي أو الجهة الرسمية. Abstract: This study aims to highlight the importance of documenting marriage contracts, the impact of artificial intelligence on the conclusion of marriage contracts, and to clarify the ruling on using robots to document marriage contracts in line with scientific progress and keeping up with new discoveries and inventions. Through the research, several conclusions were reached, the most important of which are: that documentation was legislated for the sake of public interest, to preserve rights and protect honor, and that the default in matters is permissibility. Therefore, it is permissible to use robots to conclude a marriage contract, which is referred to as the "smart marriage officiant." The permissibility of documenting a marriage contract using robots, acting as an intermediary between the elements of the marriage contract and the judge or official authority.
