The Promise to Donate and Its Contemporary Applications Abstract In general, a promise represents a form of transaction employed by individuals to fulfill various social and economic needs. This study specifically investigates the promise to donate (waʿd bi-al-tabarruʿ) from both theoretical and practical perspectives, guided by the central research question: To what extent can the promise to donate be effectively utilized within the framework of contemporary Islamic financial transactions? The objective of this inquiry is to develop a coherent and accurate conceptualization of the notion, critically assess the ongoing juristic debate concerning its binding nature, and systematize its modern applications in a manner that underscores its contemporary relevance. Employing analytical and critical methodologies, the study offers a precise definition of the promise to donate and categorizes it according to whether it is absolute or conditional. The findings suggest that such a promise is binding upon the promisor both from a religious (diyānah) and legal (qaḍāʾan) standpoint, particularly when it is formally documented through recognized means. Additionally, the study demonstrates that the promise to donate may serve as a legitimate fiqhi basis (takyīf fiqhī) for certain innovative contractual arrangements, such as Islamic insurance (takāful), and as a permissible alternative to conventional mechanisms that are prohibited under Islamic law, such as penalty clauses and capital guarantees provided by investment managers.
