Abstract : he principle that the criminal charge places the civil suit in abeyance aims to prevent contradictions between civil and criminal judgments and to ensure the binding authority of a criminal ruling over a civil one. Its application requires the initiation of criminal proceedings and the unity of the facts underlying both the civil and criminal cases. Some legal interpretations broaden its scope to include all civil claims with monetary demands, whereas others limit it strictly to civil claims seeking compensation for damages resulting from a crime. When the required conditions are met, the civil court must suspend proceedings in the civil case until a final decision is reached in the criminal case. However, the suspension order is temporary and may be reconsidered or revoked by the civil judge. If any of its conditions are not met, the civil judge proceeds with the case without waiting for the outcome of the criminal judgment.
