الإضطراب العقلي و إنعكساته على المسؤولية الجزائية

الملخص
يعد الجنون من أبرز العوامل التي تلقي بظلالها على المسؤولية الجزائية، وتحول دون مساءلة الفاعل باعتبارها مانعا قانونيا. ورغم استقرار التشريعات على هذا الاعتبار، فإن المفهوم القانوني للجنون لا يزال معقدًا وواسعًا، لكونه يتقاطع مع العلوم الطبية من جهة، ومع القانون من جهة أخرى. لذلك يظل من الضروري إعادة رسم حدود مكانته داخل النظرية الجزائية بعد توظيف المصطلحات الجديدة، وإخضاع شروط عدم المسؤولية الجزائية للفحص بما يضمن فعاليتها، بدون تجاهل تبني صور أخرى تتوافق مع نظرية الإدارة المتدرجة. فإذا كان من المتصور اختزال الجرائم التي يرتكبها الأشخاص المصابون بما يوصف بالجنون إلى مبدأ الأحداث العرضية التي تحدث عن طريق الصدفة، فإنه لا ينبغي تجاهل حقوق الضحايا والاستمرار في حركة الاعتراف بهم لتشمل جميع المحاكمات خصوصًا مع تبني المشرع لفكرة الفصل بين مسألة الارتكاب المادي للوقائع ومسألة المسؤولية الجزائية.Insanity is one of the most prominent factors affecting criminal responsibility, as it constitutes a legal impediment that precludes holding the perpetrator accountable. However, this concept is complex and multifaceted, lying at the intersection of medical and legal sciences. It therefore appears essential to reconsider its contours within criminal law theory, particularly in light of the adoption of new terminology, and to re-examine the conditions under which criminal irresponsibility is recognized, in order to ensure their effectiveness. Moreover, it is important not to overlook the need for alternative conceptual frameworks that align with the theory of diminished responsibility. While crimes committed by individuals with mental disorders may be reduced, in principle, to accidental occurrences or incidental acts, the rights of victims must not be neglected. The momentum toward recognizing victims' rights should extend to all judicial proceedings, especially with the legislator adoption of a legal distinction between the material commission of the act and the question of criminal responsibility.
