الملخص
ملخص: تهدف هذه الورقة البحثية إلى بيان تقرير المشرع الجزائري للوصية الواجبة في قانون الأسرة الجزائري والتي سمَّاها ب"التنزيل"، وذلك من أجل علاج مشكلة الأحفاد الذين يتوفَّى أبوهم أو أمهم أو كلاهما قبل وفاة جدهم أو جدتهم، حيث نص قانون الأسرة رقم 84- 11 وهو أول قانون خاص بالأسرة في التشريع الجزائري على تنزيل الأحفاد منزلة أصلهم في التركة تبعًا للشروط المنصوص عليها في هذا القانون. ودفعًا لأيِّ التباس، أو غموض قد يُتوهَّم في هذه المسألة جاءت اجتهادات غرفة الأحوال الشخصية والمواريث لدى المحكمة العليا لدفعه، أو رفعه، لما لها من دور هام في تفسير النصوص الغامضة، وتقويم الأحكام والقرارات التي تصدر من المحاكم الابتدائية أو المجالس القضائية، وحماية لحقوق الأحفاد الذين لم يترك لهم مُوَرِّثُهم شيئًا وتفعيلاً للنصوص القرآنية والسنية التي سنذكرها في المتن. الكلمات المفتاحية: وصية واجبة، قضاء، تنزيل، اجتهاد، جد، أحفاد، وارث، أسرة. Abstract: This research paper aims to clarify the Algerian legislator's report on the mandatory bequest in the Algerian Family Law, which it referred to as "the descent," in order to address the issue of grandchildren whose father or mother or both pass away before their grandfather or grandmother. The Family Law No. 84-11, which is the first specific law on family in Algerian legislation, stipulates that grandchildren are to be treated as their ancestors in the inheritance according to the conditions set forth in this law. To avoid any confusion or ambiguity that may arise in this matter, the interpretations of the Personal Status and Inheritance Chamber at the Supreme Court have come to address it, as they play an important role in interpreting ambiguous texts, rectifying the rulings and decisions issued by primary courts or judicial councils, and protecting the rights of grandchildren who have been left with nothing by their deceased ancestor, and to activate the Quranic and Sunnah texts that we will mention in the body.
