الملخص
في ظل التقدم العلمي والثورة التكنولوجية والذي صاحبه قصور في القواعد العامة فيما نجم عنه اختلال في التوازن العقدي مع رهن أمن وسلامة المستهلك كنتيجة لإقباله المتزايد واللامتناهي على التقنيات الحديثة والسعي لإشباع رغباته وتحقيق رفاهيته مما اعترى فكرة الخطأ من عدم القدرة على مسايرة ومواكبة التطور الصناعي والتكنولوجي المتلاحق، مما دفع الفقه والقضاء إلى البحث عن أسس جديدة لفكرة الخطأ والتي من شأنها مواكبة المخاطر المستحدثة من جهة وضمان تعويض المتضررين وتمكينهم من تعويض عادل لجبر الضرر الذي طالهم، وكان المآل إلى المسؤولية الموضوعية المستند على أساس موضوعي متمثل في عيب المنتوجات، إلاّ أن الجلي والواضح في ظل المستجدات الراهنة أبانت على قصور المسؤولية المدنية في مسايرة المخاطر المستحدثة في ظل وجود الضرر مع غياب الخطأ أو العيب كالرقمنة ومخاطر النمو التكنولوجي والأخطاء الطبية، ناهيك عن انعدام المسؤول عن الضرر كمضار الجوار غير المألوفة. In light of scientific progress and the technological revolution, which was accompanied by shortcomings in general rules, resulting in an imbalance in the contractual balance with the consumer’s security and safety as a result of his increasing and endless demand for modern technologies and the pursuit of satisfying his desires and achieving his well-being, which affected the concept of error due to the inability to keep pace with the successive industrial and technological development, which prompted jurisprudence and the judiciary to search for new foundations for the concept of error, which would keep pace with emerging risks, on the one hand, The affected People and enable them to obtain fair compensation to redress the damage they have suffered, The outcome was objective liability based on an objective basis represented by product defects. But the obvious and clear, the hospital in light of current developments demonstrated the inadequacy of objective civil liability in keeping pace with emerging risks in the presence of damage in the absence of error or defect, such as digitization, the risks of technological growth, and medical errors, not to mention the lack of a person responsible for the damage, such as unfamiliar neighborhood damages.
