الجانب العقابي للطفل الجانح في التشريع الجزائري والمقارن The Punitive Aspect Of The Delinquent Child In Algerian And Comparative Legislation

الملخص

إن ظاهرة جنوح الأطفال هي واحدة من أكثر المسائل إلحاحا في عصرنا، والتي أصبحت موضع اهتمام اجتماعي وقانوني على الصعيدين الدولي والوطني، ومن هنا برز مفهوم العدالة الإصلاحية للأحداث الجانحين كمفهوم واسع يلبي ضرورة الاعتراف بكون الطفل الجانح كائن بشري ضعيف يلزمه قدر كبير من الحماية، وقد كشفت النصوص القانونية في عدد من تشريعات الدول العربية عن استمرار الاعتراف بالعقوبات السالبة للحرية ضمن منظومة عدالة الأحداث، رغم تبنيها في ذات الوقت لمجموعة من التدابير التربوية والإصلاحية، وعليه تهدف هذه الورقة البحثية إلى توضيح مدى جدوى العقوبة التقليدية في تحقيق الردع ومدى تأثيرها على مستقبل الحدث وسلوكه ويبدو أن الحبس رغم مشروعيته لا يزال محل انتقاد واسع بسبب ما يخلفه من آثار نفسية واجتماعية سلبية، الأمر الذي يُعيد إلى الواجهة أهمية اعتماد بدائل عقابية مرنة تقوم على التقويم والتهذيب أكثر من الزجر والعقاب. The phenomenon of child delinquency is one of the most pressing issues of our time, and it has become a subject of social and legal concern at the international and national levels, Hence the concept of restorative justice for juvenile offenders has emerged as a broad concept that addresses the need to recognize that the delinquent child is a vulnerable human being in need of the utmost protection, Legal texts in a number of Arab countries indicate the continued use of custodial penalties in the juvenile justice system, despite the adoption of a range of educational and reformative measures, Accordingly this research paper aims to clarify the effectiveness of traditional punishment in achieving deterrence and its impact on the juvenile's future and behavior, It appears that imprisonment despite its legitimacy continues to face widespread criticism due to its negative psychological and social effects, highlighting the importance of adopting flexible penal alternatives based on reform and discipline rather than deterrence and punishment.
