تأثير النشر الرقمي على الحقوق المعنوية للمؤلف والحماية المقررة لها

الملخص
تهدف هذه الدراسة إلى إبراز التأثير الذي تفرضه شبكة الإنترنت على الحقوق المعنوية للمؤلف, والتي غيرت من الطرق التقليدية لنشر المصنفات إلى ما يعرف بالنشر الرقمي, والتي جعلت الحقوق المعنوية أكثر عرضة للانتهاك, خصوصا كونها من الحقوق اللصيقة بالشخصية, والتي تأثرت بشكل كبير بالوسط الرقمي, وتتمتع الحقوق المعنوية للمؤلف بحماية قانونية القانونية من خلال الأمر 03-05 , إضافة إلى حماية تكنولوجية والتي تقوم على استعمال الوسائل التقنية ومن أبرزها التشفير والعلامة المائية, وقد تم اتباع المنهج الوصفي في هذه الدراسة لتحديد المفاهيم المرتبطة بالموضوع وكذلك المنج التحليلي لتحليل النصوص القانونية ذات الصلة, إن ابرز النتائج التي توصلت اليها هذه الدراسة هو التأثير الكبير للنشر الرقمي على الحقوق المعنوية للمؤلف في بيئة الإنترنت, خاصة الحق في سلامة المصنفات و حق الأبوة, كما توضح أيضا عدم كفاية الحماية القانونية لمواجهة الانتهاكات في البيئة الرقمية, مما أدى إلى توفير طرق جديدة للحماية ذات طبيعة تقنية. The objective of this study is to underscore the influence of the internet on the moral right of author, it has transformed traditional publishing methods into digital publishing , rendering moral right more susceptible to infringement, this is particularly true for right closely associated with personality, which the digital medium has significantly impacted, The author's moral rights enjoy legal protection through Order 03-05, in addition to technological protection, Includes encryption and watermark. In this study, the descriptive approach was followed to identify the concepts related to the subject, as well as the analytical approach in analyzing the relevant legal texts. The study concluded that digital publishing has greatly affected the moral rights of the author, especially the integrity and attribution, It also demonstrates the inadequacy of legal protection to confront infringement in the digital environment, which has led to the provision of new protection methods of a technical nature. Résumé L'objectif de cette étude est de mettre en évidence l'influence d'Internet sur le droit moral de l'auteur, il a transformé les modes d'édition traditionnels en édition numérique, rendant le droit moral plus vulnérable aux atteintes, ceci est particulièrement vrai pour le droit étroitement associé à la personnalité. , dont le support numérique a eu un impact significatif, les droits moraux de l'auteur bénéficient d'une protection juridique au travers de l'ordonnance 03-05, en plus d'une protection technologique, dont le cryptage et le tatouage. Dans cette étude, l'approche descriptive a été suivie pour identifier les concepts liés au sujet, ainsi que l'approche analytique pour analyser les textes juridiques pertinents. L'étude conclut que la publication numérique a considérablement affecté les droits moraux de l'auteur, notamment l'intégrité et l'attribution. Elle démontre également l'insuffisance de la protection juridique pour lutter contre la contrefaçon dans l'environnement numérique et la protection technique.
