Abstract: The legal protection of irregular migrants represents a multidimensional issue, balancing national sovereignty and human rights. This topic addresses the equilibrium between safeguarding irregular migrants as individuals with international human rights and states' obligations to ensure security and regulate migration flows. At the international level, this is reflected in agreements such as the Universal Declaration of Human Rights and the Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, which emphasize the rights of irregular migrants, particularly concerning the prohibition of discrimination and the guarantee of human dignity. In Algerian legislation, significant progress is evident in addressing this group through laws combating human trafficking and regulating entry and residence, while aligning with Algeria's international commitments. The study recommends strengthening coordination between national legislation and international obligations, ensuring humane legal protection for irregular migrants without compromising national security. Irregular migrants remain a vulnerable group requiring effective legal and humanitarian protection, highlighting the need for better integration between international obligations and national frameworks to enhance this protection.
