الملخص
يهدف هذا البحث إلى تسليط الضوء على الدور المحوري الذي تضطلع به الضبطية القضائية في مكافحة الجرائم الاقتصادية التي تهدد الاقتصاد الوطني، مع التركيز على الجرائم المتعلقة بالاستثمار، تعد هذه الجرائم من أخطر العقبات التي تعيق التنمية الاقتصادية وتؤثر سلبًا على بيئة الأعمال، حيث تشمل التهرب الضريبي، الرشوة، الاختلاس، تبييض الأموال، وسوء استغلال الوظيفة، يعالج البحث طبيعة هذه الجرائم من خلال تحليل أسبابها القانونية والاجتماعية والاقتصادية ضمن إطار التشريع الجزائري، كما يتناول أهمية النصوص القانونية المستحدثة التي أُعدت خصيصًا لمواجهة هذه التحديات، بما في ذلك القوانين المتعلقة بمكافحة الفساد وتعزيز الشفافية المالية، بالإضافة إلى ذلك، يركز البحث على الأدوار المتعددة التي تضطلع بها الضبطية القضائية، مثل التحقيق والبحث والتحري، وتقييم فعالية الأساليب التقليدية والمستحدثة التي تُستخدم في التصدي للجرائم الاقتصادية، ومن بين هذه الأساليب، يبرز استخدام التكنولوجيا الحديثة مثل تحليل البيانات الرقمية، التعقب المالي، وتقنيات الذكاء الاصطناعي التي تساهم بشكل كبير في تعزيز دقة العمليات وكفاءتها. من جهة أخرى، خلُص البحث إلى أن الضبطية القضائية تُعتبر أداة فعّالة لحماية الاقتصاد الوطني من الممارسات غير القانونية التي تؤثر سلبًا على الاستثمار، وأظهرت النتائج أن توظيف التقنيات الحديثة لا يقتصر على كشف الجرائم، بل يمتد ليشمل تحليل أنماط الجرائم وتوقعها، مما يتيح الوقاية منها بشكل أكثر فعالية. في سياق آخر، أشار البحث إلى أن التحديات التي تواجه الاستثمار في الجزائر، مثل تعقيد الإجراءات الإدارية ونقص التعاون بين الجهات المعنية، تتطلب تعزيز الجهود المشتركة بين المؤسسات الوطنية والدولية لتوفير بيئة استثمارية مشجعة، كما شدد على أهمية تطوير التشريعات الوطنية وتفعيل دور الضبطية القضائية في إطار استراتيجية متكاملة تهدف إلى استقطاب المزيد من الاستثمارات وتحقيق نمو اقتصادي مستدام. وبذلك، يسهم هذا البحث في إبراز أهمية التكامل بين القانون والتكنولوجيا في تعزيز التنمية الاقتصادية وحماية الاستثمار، وفي ضوء ما توصل إليه البحث، تم التأكيد على أن نجاح الضبطية القضائية في مكافحة جرائم الاستثمار يعتمد بشكل كبير على مدى توفر الموارد والتجهيزات التقنية والبشرية اللازمة لأداء مهامها بفعالية، يشمل ذلك توفير التدريب المستمر لعناصر الضبطية القضائية على استخدام أحدث التقنيات في التحري والتحقيق، مثل الأنظمة الذكية لتحليل البيانات الضخمة وبرمجيات تتبع التحويلات المالية المشبوهة. This research aims to highlight the pivotal role played by judicial police in combating economic crimes that threaten the national economy, with a particular focus on investment-related crimes. These crimes are among the most significant obstacles to economic development, negatively impacting the business environment. They include tax evasion, bribery, embezzlement, money laundering, and abuse of office. The study addresses the nature of these crimes by analyzing their legal, social, and economic causes within the framework of Algerian legislation. It also examines the importance of recently enacted legal texts specifically designed to address these challenges, such as laws related to combating corruption and promoting financial transparency. Additionally, the research focuses on the multifaceted roles of judicial police, including investigation, research, and inquiry, while evaluating the effectiveness of both traditional and modern methods used in combating economic crimes. Among these methods, the use of advanced technology stands out, including digital data analysis, financial tracking, and artificial intelligence techniques, which significantly enhance the accuracy and efficiency of operations. On the other hand, the study concludes that judicial police are an effective tool for protecting the national economy from unlawful practices that adversely affect investment. The findings reveal that the use of modern technologies not only helps in detecting crimes but also in analyzing crime patterns and predicting them, thereby enabling more effective prevention. Moreover, the research highlights that the challenges facing investment in Algeria, such as bureaucratic complexities and a lack of coordination among relevant entities, necessitate reinforcing collaborative efforts between national and international institutions to create an attractive investment environment. It emphasizes the importance of developing national legislation and activating the role of judicial police within a comprehensive strategy aimed at attracting more investments and achieving sustainable economic growth. In light of the findings, the research underlines that the success of judicial police in combating investment crimes heavily depends on the availability of the necessary technical and human resources to perform their tasks effectively. This includes continuous training for judicial police personnel on the use of the latest techniques in investigation and inquiry, such as smart systems for analyzing big data and software for tracking suspicious financial transactions.
