تطور ضمانات الاستثمار في الجزائر The Evolution Of Investment Guarantees In Algeria

الملخص
تعتبر قوانين الاستثمار واحدة من اهم العوامل الأساسية التي تحدد جاذبية البلد للاستثمار وتعزز من ثقة المستثمرين في بيئة الأعمال، الاستثمار يعني شراء أصول ذات قيمة، تدعى الأصول الرأسمالية، يشتريها المستثمر بناء على توقعات لها إما: بارتفاع قيمتها بمرور الوقت. وإما للقناعة بأنها سوف توفر مصدراً جديداً للدخل ،وفي الجزائر تتباين الضمانات الممنوحة للمستثمرين وفقاً للتشريعات والقوانين الخاصة بالاستثمار، والهدف المراد من هذه الضمانات هو حماية حقوق المستثمرين وخلق بيئة إستثمارية مستقرة وهادئة ومغرية، في هذه الدراسة المقارنة، سوف نقوم بتقييم وتحليل الأطر القانونية الرئيسية لضمانات الاستثمار في البلاد، وتم التركيز على القوانين الرئيسية الخاصة بهذا الموضوع، وهي: القانون رقم 93-12، والقانون رقم 01-03، والقانون رقم 16-09، والقانون رقم 22-18. واستخدمنا في هذه الدراسة أسلوب المقارنة لتحليل هذه القوانين وفهم كيفية تطور وترقية الضمانات للمستثمرين. Investment laws are considered one of the most important factors that contribute to a country joining investment and enhance investor confidence in the basic business environment. Investing means buying valuable assets, called capital assets, which many buy with expectations of either: a significant increase over time. What is the conviction that it will provide a new source of income, and in Algeria the variations granted to investors vary according to legislation and laws related to investment, and the intended goal of these guarantees is to protect the rights of investors and create an existing, purposeful and attractive investment environment. In this study, we will evaluate the analysis of the main correct frameworks for the reasons for investment. In the country, focus was placed on the main laws on this subject, which are: Law No. 93-12, Law No. 01-03, Law No. 16-09, Law No. 22-18. This study was identified as important to analyze these improvements and understand the extent of experience and security upgrades for investors.
