التدابير الإدارية لحماية الحق في السلامة البيئية

الملخص
يعتبر موضوع البيئة من أهم الموضوعات التي تطرح على الصعيدين الدولي والوطني لارتباطها الوثيق بحياة الحيوانات والنباتات وحق الإنسان للعيش في بيئة سليمة المكفول دوليا ودستوريا، وأدت سلوكيات الأفراد إلى التأثير السلبي على الوسط الطبيعي لا سيما النشاطات الصناعية ما أدى لتفاقم المشكل البيئي بمحاولة الوصول للتطور الصناعي على حساب البيئة، ويتم التعرض من خلال الورقة العلمية إلى إبراز التدابير الإدارية التي اعتمدها المشرع الجزائري لتدارك وحماية البيئة والتي تتنوع بين الأساليب الوقائية والعقابية، كما خلصنا إلى عدم كفاية هذه التدابير لتحقيق الحماية القصوى أمام التدهور المستمر المشهود يوما بعد يوم . Abstract: The environmental issue is considered one of the most important topics raised at the international and national levels because of its close connection to animal and plant life and the human right to live in a healthy environment is guaranteed internationally and constitutionally. Individuals' behaviors have led to a negative impact on the natural environment, especially industrial activities, which has exacerbated the environmental problem by trying to achieve industrial development at the expense of the environment. The scientific paper sheds light on the administrative measures adopted by the Algerian legislator to correct and protect the environment, which varied between preventive and punitive methods. We also concluded that these measures are insufficient to achieve maximum protection in the face of the continuing deterioration that we witness day after day Keywords: Environmental protection; preventive measures; punitive methods keywords.
