الملخص

ملخص: تهدف هذه الدراسة إلى توضيح كيفيات تعديل السعر في تنظيم الصفقات العمومية الجزائري، وعلى الرغم من أن السعر يتسم بالثبات كقاعدة عامة إلا أنه يمكن استثناءا تعديله بسبب انتهاء صلاحية العروض أو نظرا للظروف الاقتصادية مثل التضخم أو تغير سعر الصرف، ولقد حاولنا توضيح ذلك من خلال دراسة تطبيقية على صفقة إنجاز أشغال عمومية. وتوصلنا من خلال الدراسة إلى أن تحيين أو مراجعة هي طرق تعديل سعر الصفقة العمومية حسب الحالة، وهو ما يسمح للمتعامل الاقتصادي من الاستفادة من ذلك، ويعتبر عبئ على المصلحة المتعاقدة من خلال زيادة تكلفة المشروع الأولية، وأوصت الدراسة بتحديث المواد القانونية المتعلقة بكيفيات تعديل الأسعار لتتماشى والظروف الاقتصادية وحماية لحقوق المتعاقدين وللتوازن المالي للصفقة. Abstract: This study aims to elucidate the mechanisms for price adjustment within the framework of Algerian public procurement law, Although the price is stable as a general rule, it can exceptionally be modified due to the expiration of offers or due to economic conditions such as inflation or exchange rate change, and we have tried to clarify this through an applied study on a deal In the context of public works. Through the study, we concluded that adjusting the price of public deals is done by updating or reviewing prices according to the situation, which allows the economic operator to benefit positively from that, and is considered a burden on the contracting interest by increasing the initial project cost, and the study recommended updating the legal related to the modalities of Adjusting prices to match the economic conditions and protect the contracting rights and the financial balance of the transaction
