Abstract: The state is considered a legal entity that must manage its administrative apparatus efficiently. This requires the recruitment of natural persons through the appointment of employees who form a major part of the executive authority. Constitutions, such as the Basic Law in the Sultanate of Oman, guarantee citizens' right to hold public office under specific legal conditions. The Civil Service Law regulates everything related to the appointment to public positions and the methods of filling them. In exercising its authority to issue administrative decisions, the administration is required to adhere to the principle of legality, ensuring that its decisions are subject to annulment if they violate the legal conditions and general provisions for holding public positions in the state.
