الملخص
ملخص: تتجلى أهمية هذه الورقة البحثية في مُعالجتها لأحد أبرز مجالات القانون، والمتمثل في السلطة القمعية الممنوحة لبعض هيئات الضبط الاقتصادي، والتي تهدف إلى حماية الأعوان الاقتصاديين والمتعاملين، من خلال فرض العقوبات اللازمة على المخالفين. وتبرز هذه الأهمية بشكل خاص في ظل انطلاق الدولة في تنفيذ سلسلة من الإصلاحات الاقتصادية، وسعيها إلى تعميم مبدأ المنافسة في مختلف القطاعات الاقتصادية والمالية، تماشياً مع التعديلات الدستورية التي كرّست حرية الاستثمار، ومنعت الاحتكار والممارسات المنافية للمنافسة الشريفة. كما تبرز أهمية هذه الدراسة من زاوية أخرى، إذ تسلط الضوء على نمط جديد من الهيئات الإدارية المستقلة التي تختلف عن الهيئات التقليدية، كونها لا تخضع للسلطات الثلاث المعروفة، سواء من حيث الرئاسة أو الوصاية. وقد منحها المشرع صلاحيات واسعة ووظائف متعددة، بما يضمن تحقيق الفعالية في أداء مهام الضبط التي أُنشئت من أجلها. Abstract: The importance of this research paper lies in its examination of one of the most prominent areas of law, namely the repressive authority granted to certain economic regulatory bodies. These bodies aim to protect economic agents and operators by imposing appropriate sanctions on violators. This significance becomes particularly evident in light of the state’s launch of a series of economic reforms and its efforts to generalize the principle of competition across various economic and financial sectors, in accordance with constitutional amendments that enshrine investment freedom and prohibit monopolies and unfair competitive practices. Moreover, the importance of this study is further highlighted by its focus on a new type of independent administrative bodies that differ from traditional ones, as they are not subject to any of the three conventional powers, whether presidential or supervisory. The legislator has granted these bodies broad powers and diverse functions to ensure the effectiveness of the regulatory mission for which they were established.
