الضمانات التأديبية للحكم الرياضي في قانون الرياضة الجزائري. Disciplinary Guarantees For Sports Referees In Algerian Sports Law.

الملخص
في إيطار القانون الرياضي الجزائري ، سعى المشرع في القانون رقم 13-05 المتعلق بتنظيم الأنشطة البدنية و الرياضية إلى إقرار ترسانة من الضمانات التأديبية لضبط العلاقة بين الحكم و السلطة المختصة بالتأديب بواسطة تحقيق توازن بين انضباط الرياضة و حماية حقوق الحكام و ضمان العدالة خلال الاجراءات التأديبية . واعتمد في وضعه لهذه الضمانات على جملة من القواعد الاجرائية والشكلية و الموضوعية في كل مراحل المتابعة التأديبية ، بدء من تحريك الدعوى إلى ما بعد إصدار العقوبة باستعمال الطرق الادارية و القضائية . هذه الضمانات مستمدة من القوانين العامة المتعلقة بالوظيفة العمومية مع مراعاة خصوصية المجال الرياضي. غير أن تلك القواعد المقررة للضمانات التأديبية للحكم الرياضي تظل تتصف بالقصور وتفتقد للوضوح بسب تأثير الضغوط الخارجية و النفوذ الرياضي ،غياب الاستقلالية الكاملة للجان التأديبية وكذا بطء إجراءات الطعون ، ما يستلزم تقديم توصيات لتعزيز الإنصاف و رفع كفاءة المنظومة الرياضية ، مما يضمن تطبيق العدالة و تأمين بيئة رياضية نزيهة و محترفة . Within the framework of Algerian sports law، the legislator sought in law No 13-05 regulating sports activities، to establish a set of disciplinary guarantees ، to regulate the relationship between the referee and the competent disciplinary authority by achieving a balance between sports discipline ، protecting the rights of referees ، and ensuring fairness during disciplinary proceedings . In establishing these guarantees ، the legislator relied on a set of procedural ، formal ، and substantive rules at all stages of the disciplinary process، from initiating the lawsuit to issuing the penalty ، using administrative and judicial means . These guarantees are derived from general laws relating to public service ، taking into account the specificity of the sports field. However, ، the established rules for disciplinary guarantees for sports referees remain flawed and lack clarity due to the influence of external Pressures and sports influence ، the lack of complete Independence of disciplinary committees ، and the slow pace of appeal procedures. This necessitates the submission of recommendations to enhance fairness and raise the efficiency of the sports system, which ensures the application of justice and secures a fair and professional sports environment.
