الملخص

تعتبر مؤسسة المسجد من أقدم الموسسات الوقفية الفاعلة في تاريخ المسلمين وكانت لديها أدورا متقدمة على مر عصورهم، ذلك أنها تتصل بأبعاد حضارية زيادة عن دورها الديني ، إذ عني المسلمون بتشييدها وبنائها، وأضافوا لها إضافات كمرافق وهيئات لا تنفك عنها غالبا، فانبجست بعض الإشكالات الشرعية التي قد تمس بجوهرها الدياني ، وبحث الفقهاء مسائل البناء فوق المسجد وتحته واعتبار مافوق المسجد مسجدا وماتحته كذلك و المرافق التي يمكن إضافتها إن ألجألتنا الضرورةإليها. يهدف البحث إلى ضبط أحكام تلك الأبنية من الناحية الشرعية ، مع إبراز أهمية بعضها على بعض وترتيبها ترتيبا أوليا إذ إن فقه الأولويات هو ما يحتاجه الزمن المعاصر الذي تشابكت فيه الأقضية والمعارف المستجدة. Abstract: The mosque institution is considered one of the oldest active institutions in the history of Muslims and it has had advanced roles throughout their ages, as it relates to cultural dimensions in addition to its religious role. Which may affect its religious essence, and Jurists discussed the issues of building above and below the mosque, considering what is above the mosque as a mosque and what is below it as well, and the facilities that can be added if necessity dictates . The research aimed to control the provisions of these buildings from the legal point of view, highlighting the importance of each other and their initial arrangement, as the jurisprudence of priorities is what is needed in the contemporary era in which districts and new knowledge are intertwined.....
