The Foundations Of Criminal Speed Through Electronic Litigation During The Trial Phase

Abstract
Abstract: Scientific and technological development has led to the necessity of adapting the justice sector to keep pace with this progress, from the administrative digitization of the sector to the digitization of judicial procedures, within the framework of what is known as electronic litigation. Algeria adopted it as an innovative mechanism to accelerate judicial procedures away from the drawbacks of the traditional system. However, the practical application of the electronic litigation system encountered numerous issues, the most prominent being its impact on the fundamental principles of a fair trial. In this regard, we addressed the concept of electronic litigation, its characteristics, legal foundation, and its effects during the trial phase, as well as its effectiveness regarding the guarantees of a fair trial for both parties. This necessitates balancing these guarantees and the manner of utilizing this technology to accelerate litigation procedures at the criminal level.
