Abstract: For a long time, the French Council of State refrained from monitoring the proportionality of the disciplinary punishment to the errors committed by public officials, but since its ruling in the Lebon case, it has begun to exercise control over blatant disproportionality under the theory of apparent error of appreciation, which requires that this error appear. However, in the Dahan case in November 13, 2013 The State Council decided to exercise full control over proportionality and abandon this condition. This article aims to investigate the motives for the new decision and its repercussions on the administration’s discretionary power in the field of disciplinary, and concludes that it’s the natural end of the path of the theory of apparent error in appreciation, but its repercussions on the administration’s discretionary power and the goals of disciplinary will have a significant negative impact, unless the State Council rationalizes this judiciary in its future applications
