تفعيل قصد الواقف من شرطه إعمالا للمصلحة (على ضوء الفقه المالكي والقانون الجزائري)

الملخص
الملخص : حظيت تنمية الأوقاف باهتمام كبير لدى الفقهاء قديما وحديثا، من أجل تحقيق مقاصده السامية في المجتمعات والتي أعظمها سد حاجات المحتاجين بالتصدق بالمنفعة مع بقاء الملك، غير أنه قديما كان ينظر إليه من جانب شرط الواقف والتزام به دون مراعاة قصده فحجر عليه أحيانا حيث لم تكتمل المنفعة أو انعدمت بسبب خرابه وعدم تجديده. مع أننا نجد قديما وحديثا ممن أعمل مقاصد الواقف حين اختل شرطه سواء من مبدئه أو حين استنفذت طاقاته الحيوية. The development of endowments (awqaf) has garnered significant attention from scholars both in the past and present, with the aim of fulfilling its noble objectives in societies, the foremost of which is meeting the needs of the poor by donating benefits while retaining ownership. However, in the past, the focus was primarily on adhering to the stipulations set by the founder without considering their true intent. This sometimes resulted in restrictions, especially when the benefit from the endowment ceased or diminished due to its deterioration and lack of renewal. Nonetheless, both historically and in modern times, there have been those who have applied the founder's objectives when the condition was not met, whether from the outset or after its vitality had been exhausted.
