Environmental Criminal Poliicy Between A Deficiency In Deterrence And The Inevitability Of Review And Avaluation Title.

Abstract
This study aims to shed light on the trends of criminal environmental legislative policy, as it touched on the most important environmental penalties stipulated to confront environmental crimes. On the other hand, the most important aspects and deficiencies of this policy addresses, which are represented in particular by the weakness of environmental offenses compared to other penalties, in addition to the reliance on the state of necessity and administrative licensing as cases of absence of criminal responsibility. تهدف هذه الدراسة إلى تسليط الضوء على اتجاهات السياسة التشريعية البيئية الجنائية، حيث تم التطرق إلى أهم الجزاءات البيئية المنصوص عليها لمواجهة الجرائم البيئية. من جهة أخرى تم التطرق إلى أهم أوجه ومواطن القصور في هذه السياسة، والمتمثلة على وجه الخصوص في ضعف الغرامات البيئية والاعتماد بشكل كبير على عقوبة الحبس في مواجهة الجانح البيئي بالمقارنة مع العقوبات الأخرى، بالإضافة إلى الاعتماد على حالة الضرورة والترخيص الإداري كحالات لانتفاء المسؤولية الجنائية.
