The Audit Court: A Constitutional Institutional Mechanism For Controlling Public Funds

Abstract

Abstract: The Auditors Court is a supreme constitutional institution for subsequent financial oversight. Since its establishment, it has undergone many amendments and changes, reflecting its importance and the role it plays in protecting public funds. It carries out its assigned tasks with independence, ensuring the objectivity, neutrality, and effectiveness of its work and uses several important tools and mechanisms to audit the conditions under which public funds are managed and used by entities within its jurisdiction. It ensures the compliance of financial and accounting operations with applicable laws and regulations. The oversight exercised by the Court of Auditors aims to promote the proper and regular use of public funds by emphasizing the obligation to present accounts. It also contributes to the prevention of all forms of corruption and unlawful practices that negatively impact state property and public funds. ملخص مجلس المحاسبة مؤسسة دستورية عليا للرقابة المالية اللاحقة، عرف منذ إنشائه العديد من التعديلات والتغيرات، وهو ما يبين الأهمية الكبيرة التي يحظى بها، والدور الهام الذي يقوم به في مجال حماية المال العام، يتمتع بالاستقلالية في أداء المهام الموكلة إليه ضمانا لموضوعية وحياد فعالية أعماله، يتولى مجلس المحاسبة بعدة وسائل وآليات مهمة التدقيق في شروط استعمال وتسيير الأموال العمومية من طرف الهيئات التي تدخل في نطاق اختصاصه، والتأكد من مطابقة عملياته المالية والمحاسبية للقوانين والتنظيمات. تهدف الرقابة التي يمارسها مجلس المحاسبة إلى تشجيع الاستعمال المنتظم والحسن للأموال العمومية، من خلال التأكيد على إلزامية تقديم الحسابات و يساهم في الوقاية من جميع أشكال الفساد والممارسات غير مشروعة التي تؤثر سلبا على أملاك الدولة والأموال العمومية .
